CAFCASS safeguarding call (self rep)

Please, please, do not fret, react or worry at the moment.

If what you are saying is true, and these are just accusations - it's likely that your ex is starting to play the game that so many of us here have played.

It's a horrible, horrible feeling when you read these accusations but not one person that is going to matter has accepted them as truth.

Sadly, it's a default position by CAFCASS to restrict contact. Frustrating and mother will likely see it as a win for her - completely neglecting the needs of the child.

Your next steps for you are important.

Do not react. Do not contact her and do not give her even an inch of satisfaction.

Women have to claim domestic abuse to receive free legal costs - another disgrace but another part of the unjust nature of what we face.

How much alcohol do you drink?

If you feel like it's too much then I'd lay off it completely. Firstly, to get a clean test and secondly, to avoid making any poor choices after a few.

You are in safe hands here mate.

Try your best to put it to one side and sleep on it all for a few days.

Nothing is getting sorted out for you for a while now so be calm.

I am not reacting because I know the claims are false, I had 2 pints back in January on my birthday and really am not a big drinker.

I cannot afford to get representation however I will be getting a barrister for my final hearing?

Allegations are just that = allegations

Expect plenty of them and some that are quite petty.

The thing is with allegations, you can't prove a lie. The burden of proof is on them and evidence does the talking.

I would get anxious from just opening an email from the ex's solicitor, or a general email from the court. You will build a thick layer over the course of your case and you will become numb to the words you see on a piece of paper.

Stay strong and keep focused.

I know cafcass have to investigate this further and in the long run I will be happy for them to get to the bottom of it and know that they are false.

Even though it was a tough read I feel one step closer to my daughter and I can deal with that!

The lies will eventually run out believe me. Let Cafcass do their little reports and the ex will eventually get exposed.

Don't put down the ex. Learn to speak with a different tone and narrative despite the heightened emotions.

So my fhdra is coming up next week, do I prepare my position statement for this hearing and as it is over video call how do I get my statement across to the correct bodies judge etc?

Do you have legal representation?

if not, prepare your statement and send to all parties involved before the hearing. As it's a video FHDRA then send it asap to avoid a delay with the courts processing it.

Mark the email header to the court as Urgent with your case number.

Also serve to Cafcass and the other parties solicitor.

I have just finished my position statement along with three character references from workplace, a family friend who has known me from birth and my ex landlord who knows me well.

Have sent a copy to the courts and Cafcass.

My FHDRA is on Friday and am naturally nervous but believe I was very thorough in my statement and comes across positive and putting my daughter first and not getting sucked into any games.

Will keep updating on hear.

Any recommendations before the FHDRA?

Are you arranging for anybody to be with you for support during the hearing, a friend or Mckenzie friend for example?
I don't know what the feelings on Mckenzie friends are from the experienced members here.
You might have experience of being in courts but if not the whole vibe of the place and the tension can be intimidating so a little sipport might go a long way.

My FHDRA is on Microsoft edge so will be a video conference. I think I will get a close friend too come with me for support when I have to physically go to a court
 
As expected really

Had hearing on Microsoft teams, there was myself, my ex, exs lawyer, cafcass officer and 4 court workers including judge, they were all women which was a bit unnerving , is that normal?

Have another hearing scheduled for June to determine whether fact finding is necessary. Ex has to provide level 2 information regarding an alleged incident and I get the chance to respond and then determine whether a fact finding is necessary, which I’m hoping they deem no fact finding as the incident is completely made up.

Also been ordered to do a 6 month hair strand test and I have to pay £100 towards that and my ex has her half covered with legal aid.

Still not allowed any contact with my daughter but they did say my ex has to give me an update once a month via an email.

Who gives me a date for the hair strand test?
