New - advice re marital home and keys.

Hi,

Advice required if possible as to where I stand.

Divorced and moved out of marital home due to not being able to cope sleeping on the floor.

Currently in the middle of buying the ex out of the marital home which she is dragging out to the Nth degree.

We are both owners on the mortgage.

In December she had the locks changed and has not provided me with a key.

Her boyfriend almost 100% lives in there (although they claim it’s not the case) and has keys to it.

After almost 4 months of asking her I have had no choice to inform the solicitor about the keys.

She is a control freak and is quickly running out of things to control.

Can anyone advise on where I stand with her partner (who doesn’t live there…) having keys to my house?

Are you joint owners of the house 50:50?
If you both own the house you have as much right to be in there as she does.
You also have the right to get a locksmith to change the locks or let you inside the house as it is your home too.

Your ex can give keys to whoever she likes but this partner has no right of ownership of the house so cannot dictate or make any house related decisions or stop you from going there.
 
I think it might be different if you're separated. Also didn't you say you were divorced as well?
