Hi guys, I posted around Christmas on this issue, but unfortunately did not receive any replies.
I wonder if anyone has any information regarding this.
A CAO was issued last year and we’re already butting heads regarding interpretation of the order.
The issues are:
- division of school holidays
- the definition of school holidays and what should be incorporated
- Christmas dates
The division of holidays I believe should start from the day after they break up from school until the day before they return. It is disagreed by the other party and they believe it should start on the weekday (normally Monday) and end on the final weekday (normally Friday). This means that on occasion one parent would lose a weekend and potentially gain 2. I’d like this to have all weekends included, making it fairer for everyone.
Non pupil days and bank holidays often are tagged onto school holidays and currently are set so that each parent receives them depending on whether it’s their day or not. I believe it would be fairer if they were just included as part of the holiday if they fell as such.
Christmas has been divided into a very disjointed 5 days of disruption which doesn’t allow time to see extended family. The court took no care about half of our family living 3 hours away, and we struggle to get to and from there in the time allocated, meaning our child misses out on time with her extended family over each Christmas. I propose a Christmas Eve & Christmas Day and Boxing Day & 27th alternating each year to ensure our child has time to spend with each family. This only impacts me.
My ex partner has decided that she does not want to communicate with me and believe I want to control the situation, whereas I just want things to be fair.
My daughter dislikes the current arrangement, particularly over Christmas.
What are my next steps? I presume mediation and C100. Or is there something else I need to apply for to request a variation?
