Reducing CMS liability

I expect to be completing form 100c later this year
I am already paying my ex the 8% she is due while I don't get to see my son
When I've gone through court and hopefully come away with a child arrangements order - live with order, i expect my CMS liability will reduce as my son will be staying overnight with me, though i will incur significant expenses in pick-up/drop off
When and how do i make the request that the CMS adjust to lower my monthly rate based on both shared care and expenses?
In terms of the expenses how is this processed? It would cost me about £25 in fuel one way, I'll have to make both journeys so £50 in fuel each time to see my son, I understand this expense can be offset by reducing my CMS

Hi mate, sorry you not seeing your child at the moment. You've found a great place to find support and hopefully some answers,

Firstly, where did you get the 8% from? Its standard at 12% for one child, then 16% for 2 and 19% for three (This is of your gross income). What are you looking to get in terms of a time split? 50/50 75/25????

It all depends one the amount of nights/time they spend with you. This then goes into the CMS sausage machine and spits out a number based on that.

As for expenses, I'm pretty sure you don't get a deduction for travelling to do pick ups/drop off's. But I may be wrong. A quick Google just found this. Good luck getting them to process it though..... imagine the grief having to supply them with weekly fuel bills etc..... nightmare

The Child Maintenance Service (CMS) can consider certain expenses when calculating child maintenance, if the paying parent requests it. These expenses are known as "special expenses".

Special expenses that can be considered
  • Costs of travel to maintain regular contact with the child

  • Costs of supporting a child with a disability or long-term illness who lives with you

  • Repaying debts from a previous relationship

  • Boarding school fees for a child you pay maintenance for

  • Mortgage, loan, or insurance payments for the home you used to share with the receiving parent

9yo from marriage, had the joys of divorce there
18mo from a more recent relationship
Therefore only liable for 8% of the 16% for my son who i don't see
As I have my 9yo 50:50 there's nothing owed there, didn't stop my ex spitting out 'what about my mine' when she found out I was paying maintenance, mentality monster

Sounds like have a fun time buddy!! Is that how the official CMS calculation works out?? If its correct then that's a proper result. I'd be happy with that. I'm really shocked they don't view it paying for one child at 12%
 
Yeah I'm thinking the same, surprised they don't claw every potential £ the miserable saps

I'll submit my mileage expenses down the line when I have my young lad back home following court order, expect the ex will take that as her cue to break the order
