Potential to breach CAO

Has anyone had an ex try to put the child into pre-school for 30 hours a week from 15, telling the dad that he will miss out on court ordered interim arrangements? If you have how did you deal with it? The ex is trying to do this to my son and when he said he doesn’t want their son going to preschool when he is supposed to be with him as ordered by the court, she called him selfish and said he should agree.

Not experienced it with nursery but my partners ex did put his daughter into dance classes on the days that he was suppose to have his daughter. They were in the process of court at the time and the judge said he had to stick to the dance class day/times. It meant my partner had to spend the whole day at the dance class with his son as he had to move her round from class to class throughout the day. Thankfully it didn’t last long. With a nursery though it’s not an activity as such so I would imagine your son would be well within his rights to collect his child early or not take them to nursery on the days he has his child as it would be up to him where the child is on his days unless a judge said different.

Thank you for your help. He’s told her again that he does not agree to put him in preschool when he is due to be with him and said she will be in breach of the order if she does put him in. We will wait and see what she does next.

If she puts him in preschool against your sons wishes I’d give a copy of the interim arrangements to the preschool and tell them he won’t be attending on the days the court has ordered his son to be with him.
