Am facing the usual allegations to both Cafcass and the court via a position statement that I have MH issues and drink to much etc. Cafcass safeguarding letter recommends GP letter and Alcohol testing and a section 7.

FHDRA was cancelled (no judge) and the hearing has been re-scheduled for early Jan. Along with the new court date was a court order to obtain a GP letter concerning mental health, but no mention of Alcohol testing. Anyone got any ideas why they wouldn't they ask for both prior to the hearing if they were going with Cafcass's recommendations? I would have thought they would have ordered testing at the same time???

my ex made allegations of alcohol misuse , it is very common. Like you, the court asked for a letter from my GP, for which I duly got for a small fee. They might not order it at this stage as they may feel it's not relevant. What you could do is order your own peth test and arrive with it at court and serve if required. As for MH issues, again, very common, it would be for the court decide if they are relevant and what and how they would want undertaken.

Similar issue 5 months ago. I have my DRA 10 days time and looking golden with s7 report.
Stop drinking now...period. If you like a drink wait 4-5 weeks and get a court approved Peth test...then get another 4 weeks later.
Having two months low social or zero results emailed to Caffcas officer doing s7 report will be very robust. £30 GP letter request regarding mental health and substance use is paramount. I would ask to see short run of your medical history as well as sometimes previous mental health issues ie stress depression can be labeled "on going" when they are not by several years...I had to date that to my surprise 20 year previous as a youngin...be aware.
Get a good character ref letter from employer stating on time / no issues with substance use. (Make sure you email request formally from employer not 'hey mate do me a favour'...other side legal will ask.) If that's all in before s7 report deadline things are in your strong favour and included.
I did above and s7 report recommends no issues and 6/14 contact to resume...get in before asked is my advice.
 
£30 for the GP letter? I had to order one a couple months back and the cost was £300! That was just for a summary of any MH or alcohol entries, the letter was one paragraph and said no entries in relation to either.

So I guess my point is.... as Caffcas recommended alcohol testing, GP MH letter and a section 7, why would the court only order the GP letter and not the testing for a delayed FHDRA? Could they want to see the outcome of the GP letter before deciding on testing and a section 7??

They might not even order it after hearing. My solicitor stated that its not that common an order. I would self fund and do it anyway and forward it to the officer for their S7 report. It saves time, shows your pro active to dispel allegations and can really influence the S7 report outcome. If I hadn't included it pre s7 report my FHDRA next week would certainly ask for it on exs request...slows thing up and stresses more. Its a no brainer really.

Can I ask how come you had a S7 done before FHDRA?? I thought these were ordered at FHDRA depending on Caffcass recommendations etc??

There were counter allegations by ex after my C100 application. This caused a s7 report (alcohol/MH) request after my cafcass safeguarding letter at gatekeeping hearing. I got straight onto testing and as much supporting 'evidence' as I could and had it ready for my S7 interview at home. Glad I did, cost me a fair bit...but man alive, it was worth it.
