If I were you I would contest the allegations and try to show the court they are false. If you have enough evidence to show they are false and/or have evidence that will discredit her as a reliable witness/victim then this will go in your favour at a fact find hearing. As there is no child arrangements hearing, in you case to prevent a non mol and occupation order being awarded to her you will need to go for a fact find to show why it’s not necessary.

You should still speak to a solicitor even if on for the 30 minutes free. Or citizens advice can assist you especially with regards to the occupation order.
 
Thankyou. I'm still looking at making my own statement and representing myself on the hearing.

Do you mean legal advice around the finances? I have had some already, the short being is that it will get expensive using solicitors for too long.

This issue here is how long this process will take. If the order last 6 months for example, it is almost not worth contesting and just go for an undertaking. Otherwise it seems being awarded the order is almost a given which just seems really unjust.
 
It's to review the papers, have a meeting I assume for 1hr and time to write the advice. Would a barrister be possible at such short notice?

When’s the hearing?

My son got a barrister 4 days before a hearing, he was the applicant for a nmo. The barrister even reviewed the docs and had 2 hours on FaceTime and wrote advice up for £500. Then the hearing and writing a position statement was £1500.

He just called a barristers chambers in London that did direct access and they allocated someone.
 
Why would you need to get a Barrister or solicitor for a NM, be that an application or defense against one?
They system is set up so you don't really need their inputs.

I applied and gained a NM against my ex and successfully defended against a counter application by her that she came alone to with a solicitor, and i wiped the floor with both of them making them look like idiots.

Cost her £3k for this solicitor to make an completely baseless application that was a complete tissue of lies and got ripped apart and dismissed within 30 minutes.
I'm 100% sure this solicitor knew this and simply tagged along as they were getting paid £3k whatever for a few hours work, more fool her..

This is interesting..when you say the system is set up to not need one, surely that's more on the side of an applicant?

I have false allegations against me, there may be one I can have hard evidence for where it is clear she lied however the remaining are her saying I said or did this and supplied audio evidence of the argument surrounding it. How strong does evidence need to be?

I was thinking if it waa for the occupation order as well...................I am not sure how you would try and prevent an occupation order which is a much bigger stake than an NMO (arguably!)
