No CAFCASS report before FHDRA hearing

Hi, due to have FHDRA hearing next Tuesday (12th November) but CAFCASS still haven’t got in touch to arrange the telephone appointment so they can write their schedule 2 letter. My ex-wife’s solicitor has emailed mine yesterday saying they are going to push for a section 7 report to be done at the FHDRA and said
My understanding is that the CAFCASS safeguarding letter will be provided by 12th November, however on the basis that we will be suggesting to the court there be a Section 7 report undertaken, our position is that we believe the FHDRA hearing should be effective, in order to move matters on. If the hearing is adjourned, this will simply delay matters by several months, whilst we wait for the safeguarding letter to be prepared and a further hearing to be listed.
I was only served less than 2 weeks ago so the hearing seems to have been listed very quickly and this hasn’t given CAFCASS much time to get in touch and do a report. Anyone gone into their FHDRA hearing without CAFCASS having got in touch or does this mean the hearing will be adjourned?

Hi

I don't think this is unusual. For example in covid FHDRAs were being skipped and cases were going straight to cafcass

Are you expecting allegations to be made
Know mum is going to say they don’t want to come. She put in her application that “the children have expressed concerns during their time at the house and the negative comments and actions are concerning”. The children are 5 & 6. So yes, I think there will be allegations based on that.

OK so it may well go to a s7 with cafcass.

My FHDRA was effectively skipped and maybe others have experience of what you're likely to face.

The kids being so young and not wanting to come should hopefully be a red flag to the courts.

Has there been anything reported to police or social services etc
Only by me. My partner is a teacher and senior member of staff and was concerned about the amount of gp visits, made up illness and constantly looking for something to be wrong or getting a diagnosis. She got in touch with the nspcc for advice who advised to make a referral to social services and did it for us. Then we followed it up a couple months later. No other police or social care involvement since we last went to court in February or when the order was made 20 months ago.

I called cafcass yesterday as I hadn’t heard and then had my interview this morning and it seemed to go well. Was a man which gave me some hope. He said can’t see why she’s gone to court again as nothing has changed, not made her concerns clear at all which she should’ve done and can’t see why a section 7 should be needed. He’s speaking to her now and then will call me back to discuss if there is anything to talk about after speaking with her.

All sounds positive. I think the more recent directives from cafcass are to investigate documented claims like police reports etc (regardless of whether action taken). Less emphasis on allegations that aren't tied to specific events that can be checked and verified etc.

As you mention it appears there will be something pulled from the hat in court and as this forum will attest always be wary.

I have a question on cafcass if my safeguarding report was submitted on the 11th as they said they would do by then should I of received it that day ? Do they email or post there reports to you ?

Court hearing was today and got a call from CAFCASS saying the report had been sent. That was an hour and a half before the hearing took place.
