Last year I accepted an NMO on the basis of no admission and no fact findings, it has a date that expires couple of weeks ago, i was expecting that ex wife will renew it but i havent received anything yet, what does that mean, NMO still in place or expired? she tried to renew it but judge didnt grant it? or she can do it anytime she wants, not that i care about this nmo but good to know what to expect.

also no cao in place yet, i intend to do it via c100 route as mediation doesnt seem to be helpful so far.

if i apply for cao via court and there is no nmo in place, does that mean she will get legal aid? because so far she was able to claim legal aid, thanks to false accusations and bail conditions in past which do no exist anymore, all arrest cases dismissed by Police.

as ever many thanks for your advise.
Regards,

If I go on my case. You should get notice from court if she applies to renew.

Regards the CAO she can still apply for legal aid ( irrelevant of past NMO). Whether she gets it or not is a different thing.

NMO or undertaking ? An undertaking cannot be renewed, not ever, it would require a fresh NMO application. An NMO can only be renewed if there is clear evidence of breach of the original NMO and this would be required at application , with no evidence, the court would simply refuse to grant and that would be the end of it.

on what grounds you think she can get legal aid, because if she gets legal aid that means she gets a solicitor and that changes everything , i mean solicitor uses all the dirty tricks in the books to prolong the case etc.

She can contact DV charity or GP and claim domestic abuse. Doesn’t mean she will get it
