Legal Aid

Hello - my ex and I have a court date for a few months time. She has been laying the ground work for accusing me of harassment (not the case) and I believe so she can get legal aid for the court proceedings. Will I be informed if I am accused of harassment and she has been successful in her legal aid application?

She may fill in a C1A in response to your c100 filled with any allegations, which for the most people are false in order to obtain legal aid. The first you will know if she’s got legal aid is if she’s legally represented and getting legal aid, at the bottom of the court order it will say FAS Recital, which is the information about what the legal aid firm can charge for representation.

Thank you will I receive a copy of th C1A before the court hearing?

Yes you should, and be asked for your response.

Don’t go overboard, if it didn’t happen just say it didn’t happen at this point. Don’t call her a liar or anything of the sort. Keep it factual.
You can’t enter evidence at a FHDRA, but you could prepare it for subsequent hearings if required.

In any event, if she plays that game you aren’t going to change it or stop the legal aid.

I'm 99% sure my Ex is / has received legal aid but nowhere on our (numerous) court orders does it say FAS Recital.. does anyone have any other tips for definitively finding out if an Ex is / has received legal aid? She has always had a solicitor and is always represented in court by a barrister, despite being long term unemployed.

I've been subjected to the usual false allegations of DA/DV and I want to be able to show / prove to my daughter one day (only if she confronts me about it) that it was motivated by money - and spite, obviously.

When doing responses etc consider ChatGPT as it removes emotion and can tidy up your langauge. Just a suggestion so you look as professional as you can.
Is there any guidance on the forum about how to use ChatGPT for these purposes? Is there any risk that the court might take a dim view to an AI generated statement?

I would just say be careful with what it spits out, I tried doing a position statement with it.
The result wasn’t great but there were elements I did use

Many people say solicitors are using it and charging clients. Naturally you will want to proof read and prob in areas make it a little more human. I have seen a few topic specific posts.
