We have our 50/50 CAO in place. This was rushed through at a second hearing so there was very little time to clarify or add in specifics as it wasn’t scheduled to be a final hearing.
The issue is now the court order document has arrived it is unclear and this is now causing yet more conflict.
As I understood it was agreed in court holidays remain 50/50 as per rest of year, exact days to be agreed at start of each year for all holidays. If agreement not reached on split of days then it defaults to the term time schedule.
However the the document says if we don’t have an agreement then we alternate who has the start of each holiday. If parties not in agreement on days and times then term time schedule applies.
These two things contradict each other, alternating start of each holiday doesn’t work with following our term time schedule. It only works if you are splitting down the middle week on week off and doesn’t work for Christmas where there are days court ordered. If we don’t agree and use term time schedule the days aren’t in line with alternating start of each holiday. It isn’t clear if this means start of summer holidays one parent and other parent has first half of oct half term or whoever has start of summer one year has end of summer the next etc.
EX is interpreting it as all holidays are one week each, summer alternating weeks and this overrides the court orders for Christmas Day etc.
I’m not sure why the part on alternating start of holidays has been included in the order. I am now no better off than before the order was made as holidays were the most contentious issue.
