How long do finances take?

My divorce is nearly done, waiting for ex to apply for the final order, but how long can she drag out the financials?

I want the house sold so I can get my life back on track as all my money is in the house.

House is owned 50/50.

I've sent over my financial statements and Form E.
Stbx has only sent accross financial statements and no form E on the day we exchanged financial documents. This is wrong as I did mine on time.

I'm still paying my half of the mortgage but want to be able to stop.

She either buys me out or we sell.

How can I get my share of the house and stop paying the mortgage.

Is there any court order for you to pay the mortgage? If there is not, you are no longer living at the property and you cannot afford it then I would suggest you speak with a solicitor and have them write a letter to your ex informing her that you will make the last mortgage payment in December after which she will need to pay the full amount. In the letter, you can also advise that you will consent to switching to interest only for the next six months under the government scheme if this makes sole payment easier for her.

This will be forthright enough to make clear you are not paying anymore whilst reasonable enough to give her notice and also options to manage the payment more easily.

If you carry on paying the mortgage, your wife will have a very strong incentive to drag the financials out as long as possible and it could easily take 18 months - 2 years with the court backlog.

There is currently no court order saying I need to pay the mortgage. I was just under the impression that because the house is in joint names 50/50 then I had to pay my share.

Due to stbx's allegations and bail conditions then I cant be in my home which is highly wrong as she has got it perfectly good at the moment. Got me chucked out the house with false allegations and I'm paying half the mortgage for her to live in the house and I havent been in since a year ago.

Surely I cant keep paying forever. I need to get my life back on track too.

I am barely able to afford the mortgage as also paying CMS and for the court trial.

If I stop paying can she claim more of the house?

You paying is actually setting a precedent that you can pay half the mortgage and child maintenance. You cannot, so don't try to make it look like you can of you might find yourself paying her for years. You want the finances sorted so you need to make life as uncomfortable as possible for her so that she wants to get on with it too.

Unless yours is a sharing rather than a needs case, not paying the mortgage won't affect who gets what.
