Hi all,

I am one of the very lucky ones who, haven't months of hell, has recently been awarded a 50:50 shared care order (i will sit down at some point and write my story in the court summary for you all the read!)

However, I'm now sitting here wondering about all the things I need to sort, CMS being one of them. How quickly did you file an amendment, my solicitor is pushing for me to do it ASAP, however I'm not sure if that's best for my children

It can take CMS months or even years to complete a simple task, even after they have all the evidence they need. The correct calculation would not disadvantage your children. You can overpay if you are concerned. Taking the additional away from your CMS payment would actually allow you to benefit them more. You could then pay for what they need directly and ensure the money makes a difference.

It is complicated, but possible, to demonstrate that no CMS payment is due. In all likelihood, at least initially, they will assess you as the paying parent and make a deduction. This is part of the reason I think you should get going. Services are generally poor at recognising fathers as equal parents, even when couples are together.
