Form A and finances

Why is it aggressive? And yes I will look into finances soon, hoping child arrangements get on the way properly and whilst we are waiting we can look at finances, but she has ignored my last two requests for mortgage raising capacity statements...
Because 98% of people divorcing don't need to file a Form A. They reach an agreement by consent. Going to court before you even mediate is jumping the gun a lot.

So I've been thinking about this.

If I contact the CMS and they work out I am paying the mortgage and so no longer need to pay CMS then surely this is going to be direct ammunition for my stbx to bring this up in the final hearing next month and show me as a father not paying and neglecting his children.

Then there is the other scenario, if I pay for CMS and not the mortgage payment then I'l be accused by stbx of stopping the children from having a roof over their head and stbx will make a claim in the financials that I should get less of the house as I stopped paying.

I'm screwed either way?
 
With the CMS routs and informing of the mortgage, yes the stbx will go hypersonic but it's THEIR mandate ,it's in the CMS terms etc, that will hold more substance than not paying the mortgage, the stbx will be battling you AND the CMS, treat the CMS as you goalkeeper
 
HI all, hope I'm not hijacking the thread. Am almost done with Form E prep (using a family solicitor, she's done my CAO and the attempted NMO case)
I apologise if this is interfering with the thread but I'd like to ask if you consider that completing Form E requires a solicitor or is it feasible to diy?

Well, you can always pay more if you feel that you can afford it. However, you should not be dipping into savings to do this. The last thing you want is to set a precedent that you can afford all this extra money when you can't.

Your ex has probably lied about you for financial reasons too. Her going ballistic is exactly what you want. Time it close to a court hearing to show her up as the angry, abusive money grabber that she is.
 
QUESTION GUYS - What if wife refuses to attend mediation or delays it by a month waiting to get paid, because she knows longer she delays it I can't file a Form A (and she delays all the proceedings whilst she lives at home for free). And not sure a mediator would sign it off as she didn't attend if she says she will have to wait till next pay day to fund it, but she won't resolve anything on purpose at mediation. I need to file the financial remedy order soon as really, what do you guys recommend?
 
Do you still need to do a MIAM if I did one a year and a bit ago, stbx didnt engage due to DV lies, so I left it as that. Is there any point in me getting mediation again, just to get a certificate? Seems a waste of money.

Yes, if it was over a year ago. Trust me, it is cheaper than paying the other side's costs.
 
Ok so wife is delaying mediation for finances and the order made at the CAO hearing was the below (next hearing in 3 months), solicitor thinks I can skip mediation and put urgent for form a and file, what do you think:


"Upon the Court urging the parties to consider issuing Financial Remedy Proceedings to provide theparties with a timetable to comply with"
 
Oh, and file Form A too. Give that solicitor something to prioritise (and lots of expense for your ex-wife).

I can explain how to fill it in for free so it will only cost you £330 for the application fee.
