FDA - Form E

I've received a date for my FDA and a date for exchange of finance information coming up as a result.

Upon my insistence, we have already swapped Form E voluntarily...myself thoroughly...ex not so much. We have gone into the financial remedy order process, due to my ex insisting on frankly absurd financial propositions through her solicitors.

Now we have to do it mandatory, do I have to submit all again? Or just from the dates since we last swapped?

I am hoping we are able to use the FDA as a FDR, but again, not sure best way to request.

My understanding is that most cases are sorted at FDR, I will probably be in the same boat in the not so distant future. We have exchange form e voluntarily and yes I have been thorough, her not so much and chased multiple times for the mortgage raising capacity statement but she has ignored this and I can't raise enquires or make offers without it.

I think I can only apply for financial remedy order once the twenty weeks wait is over than apply for the conditional right?

I am seriously worried that we will be stuck in this divorce for years as she will most likely do similar and make absurd offers, rather than accept reality of what will be affordable to her (especially if her comments throughout this process are anything to go by of what she wants financially). It is such a shame her solicitor wouldn't just tell her you probably won't get this if we go to court, but it is in their interest to keep her fighting and sell her a dream I guess.

So I submitted a Form A, which shows intent to seek an order.

My conditional order pronounced in about a week. So if I had reached agreement (ha!), id have to wait for that before it would be put in front of a judge (my understanding on this anyway). But given it's a long process, I thought I'd start it now

Ah ok, so what is the earliest you can submit a form A? (Sorry if silly question)

Does it save any time in the long run by doing that?

As we haven’t made offers as of yet, given the form e has been exchanged voluntarily, although she’s left a lot out.

You won't be stuck in the fiamcial wilderness for years if nothing is decided by the 2nd hearing it will go to a final hearing and the judge will decide how the finances a split

How long does this process normally take if I kick it off with a form a?

And above says quite aggressive so shall I try to get mediation first?

You need to have engaged in some sort of mediation before you submit form A ,I'm sure there's a question that states have you done it.

The whole process, depending on disclosure and exchanges it could take 9 months minimum if it goes all the way to a final, however with the court back logs and a non amicable ex it could take longer, mine currently is in its 15th month since I submitted the form A.

Wow 15th month! I mean our whole life is on hold and cannot do anything or could mean they want more.

I honestly think that’s insane…but what can you do…
