False allegations by partner, advice

But essentially there should be a realistic prospect of conviction (ie: evidence or evidence that can be obtained)
 
Thanks, it's scary that you do hear of inconsistencies though. Also I'd expect a good solicitor may be able to argue the CPS if they've allow through a crock.
 
I think it’s despicable that women make up lies about domestic violence and it hurts all women. I was a victim of serious domestic violence and went into a refuge with a 3 week old baby and 1 year old. I still made every effort to establish contact with my husband in order for him to see his children. My children have a right to both their parents and even in cases where there are genuine safeguarding issues, there are ways to ensure contact is maintained. My son has just experienced the same with his ex partner lying to prevent access. The law needs to change whereby fathers are protected from these lies and women face the full weight of the law if they lie. Anyone who tries to lie or prevent their children having contact is despicable and certainly does not have their child’s best interests at heart.
 
I'm getting worried about an NMO now if things change, it sounds like it's almost a given, if they just make up a few lies? What I don't understand is if someone is NFA'd for any allegations, clean health from SS it can still just go ahead? What are people's experiences?
 
Hello my son has been a victim of this. I am a film maker and want to make a documentary about the way the courts treat fathers. I am a genuine victim of domestic violence myself with loads of evidence and police attendance. It is horrific that women are making up false allegations regarding child matters. I really want to hear from fathers who face this for my project. My concern is that the law is encouraging women to lie to gain access to legal aid. The long term effect of this will be that genuine victims won’t be believed, never mind the devastation and cruelty of preventing children from seeing their fathers. I am planning to start filming next month.

Yeah it can. I was in the same boat. Ask for undertakings with no Facts or finding found. They then drag it all back up again when you get to Child arrangement orders...... its shit

- Make contact

Mediate -
- Sort living arrangements
- Sort finances

Get to living co-parenting lives. I understand some situations are outside this but for the majority, there's not much to it in my opinion and these orders just mess the kids up more. In my situation, they are old enough to remember this forever.

They are not so keen on going to court ref the finances as they will have to pay for legal representation as getting legal aid is a different story!!
 
Isn't it when there are DV allegations the legal help is free? Or are there certain things they can only get help with?
 
Hello women can only get legal help with child custody etc if there are issues of domestic violence. This is open to so much abuse because it’s the way of not having to pay a lawyer. Men get no legal help to defend such allegations unless they are arrested I believe. It’s appalling as it’s basically a no-brainer for unscrupulous lawyers and dishonest women to avoid hefty legal fees. Of course it’s there to protect genuine victims of domestic violence but there should be legal aid for anyone who needs it in resolving child contact issues as without it the children are the ones that suffer most

One slightly unrelated question (sorry, my minds always going), my bail form (mg04a) has the allegations listed and a date against each one, what are those dates related to? It can't be the date of the actual incidents? Anyone know?

I would guess its the date the allegation was made

Is the date a future date or a past date?
 
Past date. Some allegations are dated the day of the arrest others the next day as I ended up staying overnight due to delays and released in the morning. I'd assume they'd be one or the other if related to the reported date.

So if they are past dates they are likely dates that the crime was reported/logged as a crime. Many DA and assault offences have a 6 month statutory time limit so once 6 months to the date has passed the police cannot charge for those offences.
 
Thanks, it's odd how they span two dates as my partner reported them on the day of arrest, perhaps some police admin thing?
