Fact Finding 7 weeks away

Hi All

So I’ve self represented and navigated my way through the process.

So the I had 12 accusations made by my ex these include physical, emotional, financial and domestic abuse aswell as drug taking and alcohol abuse.

I have sent in and written my statements with evidence aswell as a witness statement from my mother.

As it stands right now my exs solicitor has now taken the accusations down to 2 out of the 12. I have shown in my evidence all the lies, I have showed abstinence on 6 month hair and alcohol test.

The only two they are pursuing now is physical violence (false allegation) and verbal abuse (false).

Her family who were supposed to be witness for her have refused to give a statement and her only witness is a friend I have met like 3 times and in thise times she has said I was verbally abusive (how convenient)

My question I have for people is, I have to send in my questions before the fact finding , how many questions is a good amount? What are some examples of quality questions?

Also now that 10 allegations have been cleared can I raise that in court to show she was lying? Or does that just get forgotten about now?

Does anyone have any self representing experience with fact finding hearings and can drop me a message to chat.

Everything I have said should be a positive right? Towards my case?

I wrote 78 questions in total and I wrote these in order of the allegations on the scott schedule. Some off the allegations were discharged by the judge beforehand. The rest were not proven.

First I pointed out the inaccuracies and inconsistencies of my ex's many statements which would question the credibility of my ex. I then pointed to my evidence which shutdown the allegations one by one.

The judge cross-examined my ex and didn't read the whole 78 I had prepared but the judge got where I was going and even added additional questions which I hadn't raised.

I had the pleasure of cross-examining her 1 witness (her friend) who she had clearly coached and wrote a completely fabricated statement.

I wrote it like a barrister from observing how I was cross-examined the day before. I actually felt confident and a sense of pleasure in exposing her lies 1 by 1.

I twisted her friend in knots and within 15 minutes her left absolutely speechless. The judge was satisfied and sent her friend away lol

Thanks so much mate, sounds like a very similar scenario , almost exactly!
 
I would make a point that the allegations were originally 12 and then reduced.

Provide evidence for the remaining 2 and get them dismissed.

Were there any police involvement for the DV allegation?

So she reported me to the police last year without my knowledge but on the police report it says she just wants it noted by the police.

Then she reported me to the police the same day she found out I went to mediation this year so can question about the timing. Which is a month after the ‘alleged incident’

I have not been spoken to by the police about either report and was unaware of them until the safeguarding letter came out by cafcass. So essentially she’s planned this because I first mentioned going to court when she went behind my back and did the birth certificate and from then she’s been planning all these weird incidents I’m proving false or sus

Don't worry about it, just highlight zero arrests or cautions.

Remember!! The burden of proof is on the one making the allegation. And it's impossible to prove a lie 🫡

Remember to remain calm. Do not say anything that is offensive towards your ex. Stick to the facts and point to the evidence.

She hung herself with her own lies.

An old saying is:

"everything eventually comes out in the wash"

Yes that’s it, I have remained child focussed this entire process and only ever spoke about my ex or relationship in response to her allegations.

Like you say you can’t prove a lie and I’m just hoping I can get the right questions together. Only 7 weeks to go
