Ex wife applying to court 2nd time to move abroad.

Hi,

Looking for some help and advice. 2 and a half years ago we had a final court hearing and the judge ruled that my ex wife could not move my children abroad to where her new husband lived.

I have now received an email from a new solicitor advising that she wants to go to mediation as circumstances have changed. They have not!! The only difference is she has been working on my children to convince them that moving abroad is what they want.

Has anyone else had to fight this again? All advice greatly appreciated. Am I going to lose my kids this time?

It does sound like she might have waited until they are 11 or 12 maybe? So the court will listen to their wishes. Having said that, even if the kids say yes we want to move, the court can decide against it as it would mean living a long distance from their Father. What they tend to weigh up is - how reliable is the Mother to stick to a long distance schedule - is she the type who wouldn't do it or would. If they suspect she's not likely to keep to a schedule of holidays they may refuse the permission anyway.

So one step at a time - she's asked you to go to mediation. You could also apply to court for a prohibited steps order to prevent the children (not your ex) from being moved abroad, and a residency order so they live with you and spend most of the holidays with their Mother.
