Ending court proceedings before FHRDA

Hi, me and the ex have been through our initial hearing regarding her moving away 300 miles with my daughter. The move was going to be chaotic and instant resulting in an emergency hearing and resulted in her giving an undertaking not to remove her from the area. We have since come to an agreement she can go in 9 months time at the end of her school year. What steps if any can we take to avoid going to the FHDRA and incurring more costs on both sides? Our Cafcass calls aren’t scheduled for another 2 weeks.

Hi mate, sorry to hear your going through the mill. I believe that if you have to an agreement then it can be written up and submitted to be signed and avoid the need for any other hearings. I;m someone who knows more can confirm this is the case.

Thanks mate, that’s what I hoped so will see what anyone else knows about it. Don’t see the need to waste any more money and the courts time

All I would say is don't rush in to agreeing anything, if your daughter moves 300 miles away how will you spend time with her? How often will you get to see her?
Just think things through before agreeing anything.

My personal opinion would to both attend the hearing self-represented and walk into court with your proposed consent order. You can then discuss this with the judge and have them agree the order and the judge give their view on what is agreed.
