Hi All. Court ordered for bundle to be created by ex solicitor.
My question: do I need to submit updated statement with new evidences to ex solicitor who is preparing bundle?
I have not received updated statement from ex. Will i put myself in tricky situation by revealing new evidence to other party?
Court date is within 30days

Q: What is the bundle for?


Be very wary. Ex’s solicitor submitted a bundle less than 24hrs before the hearing (which is unreasonable and no time to prepare). Also in this bundle they had packed new documents which I hadn’t had sight of before.

Judge previously told them that they couldn’t file anything more but they tried to sneak it in any way.

I was going to object the bundle on the day. The Judge dismissed the case and terminated her application.

Case closed!!

It is second hearing Direction Resolution appointment. Section 7 report was done ( still not received)
 
Ok so have they given you a date by which they want any documents for the bundle? They can't really complete it without the S7 - although if the S7 isn't done in time, they might complete the bundle without it. Have they sent you a list of what will be in the bundle and asked if there is anything you want to add?

What should be in it is all applications, all court orders, Cafcass reports, all position statements to date, any other documents ordered by the court (eg hair strand tests etc).

You can still submit a position statement for this hearing, before the hearing - not included in the bundle.
 
Thank you Ash. A date was given. Have not received any communication from ex solicitors. Will also ask them for a content list.
Is it ok to share updated position statement with ex solicitor? It sounds like I am handing evidence beforehand.
 
I would email the solicitors yes and ask them for the bundle list so you can see what's included and send them anything you want included.

I'm not sure what you mean by an updated position statement. Have you been ordered to exchange position statements before the hearing?
 
Yes, by court all parties shall submit their position statements by set time and date. Do I submit statement to court or ex solicitor who prepares bundle?
 
Ok so if you have to submit a position statement by a certain time and date, that will be before the bundle is submitted. So for example if it was by 4pm on 20th June, you would send a copy to both ex's solicitor and the court before that deadline. However, it's better if they are exchanged simultaneously so they don't see yours first, and then seek to undermine it by altering theirs. So one tip given to a Dad on here (which is a good one) is send it to the other side, password protected :) Maybe on the morning of that day they need submitting, along with an email saying you will give them the password once you receive their position statement. Once you've received theirs, you then send a copy of yours to the court with a covering email confirming that position statements have been exchanged. If for some reason you don't get theirs by the 4pm deadline, then you send yours to the court just before 4pm along with an email saying your position statement is attached but position statements have not yet been exchanged because you have not received the respondent's position statement yet. They will have yours, password protected.

Are you sure it says "position statement" and not "statement"? A "statement" is a witness statement and you can attach evidence. Either way, in addition to the court ordered position statement, you can still do another short position statement and send it to court the day before the hearing - either because you have something else to say or to respond to something in theirs. With that one, don't give the other side a copy till the morning of the hearing or when you get to court. So you can keep some things under wraps until the last minute.
 
It is a position statement in setting out position in a view of section 7 recommendations and proposal of future arrangements. I am still awaiting for S7 report.
 
Ah ok. So you can't even write it till you get the S7 report.
