I’m currently going through a parental alienation case and my ex has stopped me seeing my son. She has now applied for more maintenance because he obviously is spending less nights at mine. Can she do this?

I had been paying her direct but she then went through CMS to initially claim more and now wants more again. It’s financially crippling me

With no agreement like a court order the default is to assume the non resident parent spends one night a week with the kids.

Unfortunately the rotten CMS can pretty much do what they want without much challenge initially.

I'm at the MP intervention phase. 6.months in of paying considerably over the odds.

All evidence provided and little movement. My court order has eventually got me allocated the correct overnight banding but I'm still being assessed on a previous wage.

It's a horrible, horrible organisation- heavily weighted towards mothers. As soon as she clicks her fingers and reports inaccurate information they hound me for details and evidence.

It's absolutely mortifying and soul destroying.

That should get you into the correct banding for the overnights.

Are they assessing you at the correct income?

Try not to let it get to you too much.
