I am on my last payment this month after decades of both csa and cms payments ,a horrendous and degrading experience from both services . After 45 minutes trying to get through yet again, I wanted to clarify the rules on child benifit that allowed cms payments to be made ,now my youngest child turned 20 and has been in employment for at least 2 years ,cms operative told me even though she is out of education and working ,child benifit is still being paid as it all depends on circumstances of the child and parent so cms still must be paid . Is this correct as I feel there is some sort of benifit fraud going on here .
 
That doesn't seem right somehow. If the child is in education I think it covers up to age 20. The difficulty is proving to CMS that they are no longer in education - as there is no proof - only what the ex tells them/sends them. Is your child studying part time maybe? Maybe it's a certain date after they turn 20? I think they only need to be studying 12 hours a week to be classed as still in education.
 
No she been in employment since she was 18 after completing a 2 year course in collage since leaving school, not in any kind of education since then. The problem is what my ex is telling the child benifit ,it's a problem I've been trying to understand for years . She has not officially worked since I left in 2007 but clearly working cash jobs .
 
So your ex must be telling them she is still in education. Even so, it should stop when she turns 20, but it might not stop at her birthday - it might be a date after her birthday. I would phone CMS again and say she is 20 and not in education. However, they will still be assessing for your younger child so it might not be a huge adjustment.
