Hopefully a quick question. Once CMS have set a date for first payment and a payment schedule, based on when the ex applied to the CMS, can the ex then apply for payments
to be back dated to before when she originally applied?
 
I think their letter should usually tell you when the payments start from.
 
I don't think so from what I recall. As it would be very unfair to day demand maintenance for years prior.

I think it can only look backwards a period of weeks.
 
Thanks for the replies. Yes, I have a letter with a payment schedule, the first payment is for early July. I was pressured out of the family home in January,
and was in temporary accommodation until April. During that time I was paying all the bills on the family home. For that reason, plus I have our children 3 nights a week, I refused to make a voluntary payment. Once I obtained a more permanent home, I changed the bills into wife's name, apart from the mortgage. Wife applied to CMS in May. Now she wants CMS to back date payments to January. From what you are saying Roblox, CMS might back date it. If so, I can produce evidence of all the bills I've paid, trouble is, as discussed in another thread, it will probably take months to get CMS to take all that into consideration.
 
Well, to date, the CMS have not contacted me to demand back payments. However, I am in the process of
getting my payments altered due to change in financial circumstances, but that's another story.
