So my son has been in my care since he was 12 weeks old he's now 6 months old he only sees his mum 3 times a week and it has to be supervised I'm just wondering if she should be paying me any child maintenance as I've never had a penny off her and I just know if it was other way round I'd be paying her money is it worth me asking my solicitor only doubt is that he lives with me full time so I don't know weather that means she don't have to pay me money I really don't have a clue about child maintenance

Yep you’re entitled to child maintenance. Go online and apply. It’s based on overnights at either house. So you are entitled to 100%.

Her liability is only enforceable from when you register the case with CMS. So make the application without delay.

I would definitely claim the Child Benefit from the Government (about £26 a week). Whether you open a case with CMS for Child Maintenance from your ex, is up to you. Have you changed your username? I think I remember your case. Ex's alcoholism? The thing to consider is - what is her financial position? If she's on benefits, the amount she'd have to be pay you could be the absolute minimum and it might not be worth it. If she's on a good income, it might be worth it financially, but if she's not happy about the current situation she might kick off and apply to court to change things.

Just to add, my son lives with me full time and I decided not to pursue CMS. I just don't like the principle of the resident parent gaining from the non resident parent. Yes I know it's expensive to support a child (very expensive) but regular full time parents have to do it. An older child also knows they are in the middle of financial disagreement over such things and I wonder what it does to their psyche - thinking that parents are fighting over who gets them because of money (sometimes - not your situation). It would be nice if more Mothers decided not to claim it as well. Also I can guarantee my ex would find a way out of it rather than pay it. Eg give up work (she has a partner earning plenty).

Not changed my username and yeah ex is an alcoholic yeah I wrote about her taking him the pub to meet what is still happening and I checked gov website and it says mum should pay me £7 a week so it's not even worth the hassle so I'm gonna leave it
