Child Maintenance, Redundancy & Voluntary Payments

Hi All,

Haven’t been on here for some time but would like some advice if possible.

I was made redundant from my job in May and haven’t been working since. I wasn’t aware that if I reported redundancy to the CMS would revert my liability to a nil payment. I had a little money so I continued to pay the monthly payments but when I find out I needed to report it last week I did so.

CMS have said not to pay any more money until I’m back employed and have been given assessment. I have a small amount of arrears on the account and so I asked if the money that I paid during the time I have been redundant could be accounted for the arrears to clear it off - but they have said no.

Essentially because I only reported my redundancy last week, they won’t backdate it to the date it originally happened (this is despite my providing documents showing when my redundancy occurred)

This means the payments I made won’t be accounted for. Is this correct? Surely if they can backdate an increase in payments, they could backdate a decrease and account for any voluntary payments I’ve made in that time?
 
Hi there and good to hear from you :-) Although sorry about the circumstances. I can see they wouldn't backdate it because that would mean taking the money back from the ex that has already been paid. They will act from the point you inform them. So yes they'll expect you to clear any arrears and then not be eligible to pay. But as you say it's a shame they couldn't use the recent payments to clear the arrears. Very jobsworth.
