I’ve had a couple of phone calls from CAFCASS now and in all fairness you can already hear from the way he speaks to me on the phone that this is gonna go the exs way . I’ve had a letter today about a second Gatekeeping hearing . Can some one with some knowledge explain what this means

A CAFCASS gatekeeping hearing is an initial hearing in Family Court where a judge reviews the case and decides how it should proceed. CAFCASS (Children and Family Court Advisory and Support Service) plays a key role by providing safeguarding checks and advising on what further steps may be necessary to ensure the child's welfare.

What Happens at a Gatekeeping Hearing?

  • Allocation of the Case: The court decides whether the case should be heard in the Magistrates' Court or by a District Judge.
  • CAFCASS Safeguarding Letter: CAFCASS presents an initial safeguarding letter based on background checks with the police and social services.
  • Directions for Next Steps: The court may order further reports, assessments, or fact-finding hearings if necessary.
  • Interim Contact Arrangements: The judge may set temporary arrangements for child contact until a final order is made.

How to Prepare:

  • Review the CAFCASS Safeguarding Letter: If you disagree with any part of it, be prepared to challenge it.
  • Have Clear Proposals: Show that you have a structured, child-focused plan for contact.
  • Demonstrate Cooperation: Courts favor parents who show a willingness to co-parent and work towards solutions.
  • Address Concerns Proactively: If there are allegations against you, provide evidence of how you are addressing them (e.g., parenting courses, alcohol awareness programs, etc.).
