Hi everyone

Last year my ex accused me of DV and I didn’t see my son for a month, I filled out a C 100 form and started court proceedings. The case was NFA

Contact started again after a month but it was less then before the allegations, and I obv want my days back I had with him.

I Had my cafcass report through today, in the report my ex said Iv used DV against her and I take drugs and Iv slapped my son in the past… all untrue

The recommendation to the court from the report said… cafcass support ongoing spending time arrangements with me and my son.
Does this mean they are supporting what I’m getting now? If I’m asking for extra days in court, would they support that?

Any advice would be great

Are you going to DRA, that would be next, the issue will be accusations of violence against your son, cafcass aren’t too bothered about accusations between you and ex but if son affected, which she is implying. This will put you on back foot, it will make you loose time. What is your position now. The key is to get back to what was the status quo, do not let her set a new precedent.
 
Would you consider paying for a 3rd parry drugs test to show this is not the case? You could also ask for full police disclosure to show again it was NFA and the truth was told by yourself. Whilst a claim has been made that you slapped your child, this has not been reported to the police and in family court would she not have to show some kind of evidence?
The NFA is a major thing to show you are a great dad - stand firm on what you want.
