CAFASS letter

Hi, finally got the cafass letter to move forward after a few blips.

In the letter they refer to child using mothers surname name only rather than mine and mother as child has both.

It already seems biased and I’m quite annoyed. Is it worth bringing it up to ask to refer him by his full name? Or would that stir up a dislike for me

How old is the child? And is the child’s name both surnames on the birth certificate?

Was the recommendation made by carcass to only use mother’s name or has the mother said that’s what she wants? Normally a court will state a child is to be known by the name on birth certificate and a child of your child’s age will know what their name is so would be odd to recommend a change. Has the child said they want to change their name?

. Apologies I wrote cafasss letter I meant email. Haven't even got that far yet. I meant the initial email to organise the call, still very early stages. They addressed child with just the mother’s surname in the email. I doubt child has said he wanted to and nor have I received any correspondence saying so. Quite sure child’s mother would have mentioned (in a spiteful way) if that was the case.

Ahhh ok, when you speak with them I would mention that they seem to have the child’s surname incorrect and say heya it is for clarification purposes.

Yeah I’ll mention that and also legal purposes. Very strange they did that especially as my surname is first in the sequence. Left a bad taste for me but hopefully it is not a bad experience overall. Thanks for your response

Yes in your Cafcass call they may call the child's mother first or you first. If they call her first she will be asked particular questions about your child and herself and you. Her answers, if they think are relevant, will be told to you for your comments. If your child's surname is mentioned that the mother wants the child only to use her name, then you can say at that point in your reply by saying you would prefer the child to be known by the name of the birth certificate. Either way as long as your point comes out in the letter, the court will consider it. The law says that the child's name can't be changed without the agreement of both parents.

Cafcass commonly mixes up the names, it's not a deliberate bias, I would let it pass and keep your focus. However, be careful that any reports dont mix up the names in such a way that the meaning of the sentence is changed, if it does you can ask for correction or bring it to the courts attention

Ah good to know, I guess I’m just on edge as I do know sometimes they can be bias. I did respond as I had other things to confirm with them and just asked if Childs full name could be used for accuracy in for the court proceedings. Hopefully they don’t take offence to that. Thanks for your response!
