C100 and C63 Applications

Hello Beautiful Dads,

I have a beautifull daughter who is 8 years old. Her beautiful mother didn't put my name on our daughter's birth certificate.

Last 8 years she promised me, she will do. But never do.
Now she blocked me.

I went to the MIAM, but she ignored. MIAM advised me, apply C100.

After I applied C100, court return my application and ask me need to apply C63 declaration of parentage for DNA test.

I feel our beautiful daughter's mother definitely going to ignored that even court order comes also.

I am in complicated situation. I want to know from you , do I want to apply c100 again or do I want to wait until C63 out come decision?
Is any one in this situation?

I'm currently going through the c100 application for my 8 year old I'm not on the birth certificate either the mother my ex has blocked me and has refused mediation aswell , however I didn't have to complete a c63 I've been given a court hearing date which is what I'm currently waiting for I'm not 100% sure what to advise you alls I can tell you is my experience so far in a similar situation

Hi Lucky. What did you ask for on your C100 form? Presumably you mentioned a DNA test yourself? Have you been seeing your child regularly over the past 8 years? Because if so you would still be deemed to have been a parent.

Last 8 years I have been seeing her. She knows I am her father. Her mother put her ex's name on her birth certificate when she was born.
She promised me she will change, but never changed. Last 8 years I visited her, send gifts, go out with my daughter, lot's of photographs and videos we were together.

Her birth certificate has wrong father's nane. I want to take it out. I mentioned c100 i am the biological father. Then court return my application and sent directions, apply C63 form.
I applied C63 now. I want to know do I want to apply c100 again

Me too. She is my daughter. But court send me directions if I want to add my name under birth certificate, I must apply C63

I applied that. I called court also. They didn't give me right information. They asked just wait for the out come C63.
 
I assume it's because someone else's name is on the birth certificate as opposed to the Father's name just being blank. Do you know why she put her ex's name on the birth certificate if she knew you were the Father? It sounds like the court wants proof that you are the Father before they will consider a C100 application so that will be the way it has to go unfortunately. Simply because someone else is on the birth certificate.

When did you last see your daughter? I'm wondering if it's worth submitting a new C100 as well as the C63 with careful wording explaining your substantial relationship with your daughter over the past 8 years and your concerns she will be anxious at not seeing you now she is being witheld, so you have submitted a C63 as requested but would like the Child Arrangements process to commence alongside it to avoid delay for your child and also say that you have no doubts she is your child.

Yes. There is a reason but i cant share in open form. I mentioned court application that. I have proof for why she did that also. I saw my daughter 3 months before last time. Since that her mum blocked me. Last 8 years we have seen each other spent time together. Her mother mess-up the things. I tried lots of negotiations but she don't care. Last option legal help.
 
Maybe don't mention the reasons another man's name is on the birth certificate and just submit a C100 alongside the C63. I can help you word the C100 if you want.

No mate. I have to mention that name.

Because I didn't mentioned first.
Court check the birth certificate and gave me directions need to fill the name that who ever father in birth certificate.
And ask me to mentioned him 2nd respondent plus ask me to submit C63.
That person not in United Kingdom anymore ,but court ask him to mention his name and last knowing address.
 
Complicated. So technically this other guy has PR because he's named on the birth certificate and it sounds like they're establishing the parentage first. But I would still submit another C100 at the same time, because you can make the point that you have been parenting the child for years, she knows you as her Father and she will be anxious that she can't see you.

Yes, I am going to submit C100 again. I have all the proof about I am her biological father.

What proof do you have? Obviously mention in the C100 that you are also submitting the C63 as requested but have evidence that you are the biological Father. Do you have a DNA test result or something? The court seem to be assuming the guy on the birth certificate needs to accept or agree something or be consulted. Whereas actually it's your ex who has some explaining to do! Does he actually know he's on the birth certificate?

No he don't know. Before our daughter born he went to another country and never came again here. She mentioned his name that time she was legally married him and another matter. That time she promised me when the time comes she will change our daughter birth certificate.



I have all the photos including 3 of us, and other proof financially help and etc. Even DNA no need, daughter and me physically almost same. 🥰

But for legal matter I have to proof with DNA
 
I don't know I'm afraid, I haven't come across this before. I think maybe what you put in your C63 application wording might decide what happens next. Eg if you say he is aware you're the Father and no longer lives in the Uk and provide any evidence you have that you're the Father.

To help get the wording right on the C63 and the new C100, I'd need to see what you put on the original C100 - if you want to message me - you can blank names and other sensitive or identifying details out.
