Breaches

Good morning all.

Quick question from me please.

As expected, the ex is exhibiting significant bitterness since our final CAO.

She has also started to breach the order.

Contained in our order is that our children are to be known by their double barrelled surname in all formal and informal settings.

She is still applying labels to the children's clothes and school stationery. I have documented, removed these and replaced them with labels with the correct ones. I have written her two messages with the evidence and a reminder of the court order.

She is also not taking me to medical appointments, making me aware of them and ignoring my requests for information. Because she has moved I have been unable to link the new surgery to my NHS app so I am having to call the doctors every couple of weeks to see if they have been which they have.

Anyone experienced similar?
Anyone know how to link NHS app? I've been approved by the new surgery and contacted the NHS support but.no joy

How long should I allow these breaches to continue?

All best all and happy Christmas.

Hi Northernsoul,

Sorry to hear you are going through problems.

I can’t help you with most of the above as I’m still going through this nightmare but from my experience of using the NHS app they can’t be linked if you are registered to a different GP surgery to your child. I did ask my child’s GP and they asked me to email the main NHS app technical line and they advised they can’t be linked.

Like you, I’ve had to contact my child’s GP every few weeks as ex is failing to give me updates.

Thank you JC.

Couldnt make it up really could you? Surely the whole point in having proxy access is for when you are done distance from the surgery.

Appreciate your response.

No worries buddy, madness eh! Yeah you’d think so… just double checked the NHS app and it says the below. Can’t understand it, I’m sure there are thousands of people out there e.g. people with elderly relatives who would benefit from this too.

Manage health services for others

Support family members and people you care for, or allow them to help you.

Add people

Contact your GP surgery to:
  • apply to access services for someone else
  • give someone you trust access to your services
You can only add people at the same GP surgery as you

I don't think she has to take you to medical appointments, but she should keep you informed if she has taken the kids to the Doctors. Things like the name labels are typical but very much a minor breach and hard to prove as a breach really because she could just say she was using up old ones to save money or hadn't got round to changing them and name tags are not quite the same as official documents like school records and medical records.

This is more known as "frustrating" the order and to be honest, as long as she follows the order for time, there are a lot of things you just have to let go to keep the peace for the kids - but keep records, always.

I'd suggest you send a BIFF message along the lines of:

"I would be grateful if you could inform me if and when you take the children to the Doctors and any illness or conditions they may have please. We are expected to share such information, as co parents, under the court order. This hasn't been happening so please can you assure me that from now on information will be shared. Thank you."
