Amend Existing Child Arrangements Order

Need some advice. Currently have 50/50 court ordered arrangements with mum for our daughter. In September she moved 4 hours away with the agreement daughter lives and goes to school at my residence, mom will have roughly most holidays.

This was agreed in June, she said she would send an email confirming. She has dodged this for months despite multiple requests, same for giving me the new address. Today she says she will review arrangements with our 11 year old daughter and see what she wants.

What are my next steps? I need to modify the existing court order to reflect the new arrangement but I cannot get an address or get this in writing from mum.

This is a red flag. She shouldn't be getting your daughter involved. It's for the adults to arrange.
My partner and many other dad's on here have been expected to let their children step in and make these types of decisions.

You could apply to the court to vary the order. The worry is that at 11 they may ask what your daughter wants and with her mothers manipulation say she wants to live with her.

I could be wrong but I'm sure the courts can find out your exs address. Can anyone confirm this?

Agree. Years ago she attempted to kidnap my daughter, enrolled her in a new school hours away, planned to move in with her parents, etc. I was tipped off by someone in her circle and got an emergency order approved stating she could not remove our daughter from the city without my consent (for travel or living). Court order arrangements followed shortly and because of her alcoholism and stints where she would disappear on benders for several days, she reluctantly agreed to 50:50.

Either she's just dodging / thinks she can get our daughter to lie to the courts that her house is somehow more stable / believes the emergency order no longer applies for some reason.

I'm going to call the court tomorrow and see what can be done because I'm stuck on the C100 form without an address.
