Alcohol Hair strand testing - Overview or segmented

Hi chaps.

I'm pretty sure I'm going to be requested to do an alcohol hair strand test. Will they ask for a 3 month overview or will it be monthly segmented they ask for? Which one do the courts usually go with?

Thanks

Will any of them show anything they shouldn't?

If not, request the one that shows abstinence / minimal usage for as far back as possible.

Depends when my FHDRA is scheduled. Still haven't got a date. But 2 months sober now. Am hoping will have enough time to do a 3 month. But am worried that they might ask for a 6 month.

You're doing all you can mate.

If you don't have a date for the hearing stay clear of the booze and feel really proud of yourself.

What makes you think they will insist on a test?

I've been through this, it is not possible to segment hair for alcohol as hair is coated base to tip from sweat metabolites.

Your two months clear will be a zero peth test so do that now. Perhaps do another covering 5 weeks before FHDRA and hand in with your position statement.

Worked well in my case. They were not interested in historic (ex wanted a year covered) and after DRA stated 3 months peth test until final hearing half cost. I have 6 zero peth test results by then.

@Yorkdad what/how was the crap about booze thrown at you and was it just the ex or did Cafcass chime in too?

I have a long history of ex trying to be devious in creating a narrative that would indicate 'neglect' as a reason to smear me and withold child...all of these attempts have been proved officially false, historically and currently. Latest is accusation of being alcohol dependant and passed out drunk to withold child.... crazy stuff! If i had the time and money I would chase her for a psychiatric report. Final hearing few months time.

I've been really clear and honest with CAFCASS re alcohol ie 2-3 pints 1-2 times a month and they have agreed there is neither history of, nor evidence of alcohol issues, completly on my side, helped enormously with self funded peth test results mind you, was well prepared in advance.

I got busy immediately I filed C100 and got clear peth test results to give to officer for their S7 report which has been a major blow to her story and got favorable recommendations.

To be fair CAFCASS have been very good so far, think I have been lucky perhaps...def not out of woods yet though.

thanks @Yorkdad whats the time scale from FHDRA to having the s7 done?

tia
I had a gatekeeping which is a bit different as in no parties present, basically like a triage as to where it's seen and what needs done...much the same as a FHDRA really. Based on nature of allegations S7 was recommended in Cafcass letter. That was mid Aug and had the DRA few weeks back. It took 14 weeks to do S7 report from it being ordered at Gatekeeping/FHDRA.

She sent me a private child arrangements plan asking for breathalysers and a hari strand test every month! Which is mental. So I opened court proceedings via C100 as she refused to attend mediation.

you're alcohol use 6 months ago is irrelevant in family court. What they want to know is are you safe with children now, not 6 months agoive b

I've been providing breathalyser test for over a year now, never failed one or not sent one to her. She's going to push for hair strand tests as she thinks I'm abusing alcohol in the days in-between when I have my son. So are you saying the courts won't be interested in that?

So she's demanding you provide tests?

I wouldn't be entertaining that anymore.

I'd also be very wary of her CAO plan, no doubt it will be geared towards her and she might even try to make it the status quo.

Sounds like you've provided her with what she asked for and because she didn't like the answer she will keep on at you until she finds an answer she wants.

Who does she think she is playing judge a d jury?

Knock it on thr head. The courts won't care about your breathalyser tests, if she raises it in response to your C100 and CAFCASS raise concerns then you could do a peth test and knock it all on the head if it's clear.

She's refused all contact after I stopped doing them. Now her dad messaged me saying all contact should go via their legal representative. Which I did (I found his contact details via them sending email to the court informing notice of applicant and cc'd me in). I sent email straight away requesting we put in place interim contact on 19th December. No response until yesterday from her dad saying she's changed legal representative. He replied via the solicitors email in the thread in which her previous solicitor informed them of my email and suggested they send it to their new legal representative. That was 30mins after I sent my email. So they've waited 11 days knowing they could have put me in contact with the new solicitor and did nothing. Meaning I missed any contact with my son over Xmas. I requested new solicitors contact details yesterday and he said me to provide mine first as his daughter will be charged if they send me theirs, informed I will be litigant in person. Now they've gone quiet. Just waiting on the cafcass report now, deadline is 6th January. But I had my call first so didn't get a chance to hear the myriad of vitriol she will falsely claim against me. We had 50/50 care.

Pair of wrong uns.

Control freaks who will be relishing making you jump through hopes.

If the breathalyser gets you an opportunity to see your child and don't cost the earth then do it.

But, these people will create new allegations. Complete scum bags. Exactly what I faced. Classless. My blood boils.
