So you have been through family court and obtained a good court order to see your child regularly. And then the Mother suddenly moves 300 miles away. This happens a lot. Attached are details of very recent case law - where residence was transferred to the Father after the Judge didn’t accept the Mother’s reasons for moving further away (she moved to the countryside during Covid). You may need this case law if you ever need to apply for a prohibited steps order to prevent your child being moved away. The court cannot prevent a Mother from moving - as it is her human right under law. What they can do is prevent her from taking the child with her. Then it’s up to her if she wants to move a long way from her child and do all the travelling.
