Here you go. This very ruling makes absolutely clear that where an NRP makes contributions to a joint mortgage in a property that they no longer live in, this is grounds for a variation from the CMS. Rule 65 and not rule 67 applies.

Just an update on this...I have told her I'm stopping the mortgage payments....cue threats of my credit score, getting a mortgage in the future, etc. As if I don't know that?
Anyway, yet another derisory, well disrespectful too, offer.. basically a return to the first. Not really negotiation is it!
So will file Form A on Monday. Sent their solicitor into a flap when I told them.
But after 9 months, I'm not prepared to wait for a fourth offer that's likely to be poor and for more slanderous and condescending nonsense!
I still don't understand how a 70/30 split of a joint asset, with similar wages and her in receipt of all the benefit, CMS, etc is at all fair...
