Agree. If two people separate and one moves out there is a strange phenomenon in that you're both used to the kids being there all the time. So the one leaving doesn't want to leave them behind, or risk being accused of abandoning them, but taking them removes them from the other parent and their home. It is one thing to move out suddenly and take the children with you, providing they are allowed regular time back at home with the other parent, but to take them away is just downright cruel. Unless there are safety issues and then, as you say, they should immediately go to court to explain why they're witholding access. When there are no safety issues, a parent should not be allowed to just take the children away without explaining where they are. If a Father did that he would be accused of abduction and the Police called! There definitely needs to be a protocol enshrined in law, for the time that parents separate. As to what should and should not happen in particular circumstances. I suspect the issue is lack of resources for professional bodies.For example, if a Mother was hurting the children, on drugs or harming them in some way, and the Father left taking the children to protect them. Who are they going to believe? The Mother who says he has abducted them or the Father saying he is trying to protect them? If a Father was in that situation, they would immediately go to court to explain the situation - to protect themselves from being accused of abduction. But a Mother is deemed fit to just take children away without explanation somehow.
